1. CONDITIONS OF USE

Welcome to the SSDEurope website. This site is owned and operated by Capacity Innovations Ltd Bus. No. 475059, VAT No: IE 9717773J and is based in Dublin, Ireland.

These terms and conditions govern your use of and purchase of products from our website. They do not govern the offline purchase of products, or purchases by dealers (which are governed by a different Terms and Conditions of Supply Agreement).

Please note: by accessing, browsing and/or using this site, you acknowledge that you have read, understood, and agree to be bound by these Conditions of Use.

Governing Law

SSDEurope ("we" "our" "us") controls and operates this site from its office located in Dublin, Ireland. These Conditions of Use are governed by the laws of the Republic of Ireland and the European Union. Should any dispute arise howsoever related to your use of this site, you and SSDEurope agree to submit to the exclusive jurisdiction of the courts of the Republic of Ireland.

We may revise or amend these Conditions of Use at any time by posting revised Conditions to this website. Any revisions will be effective immediately. Protecting Your Log In Details

You agree to take responsibility for the safekeeping of your user name and password. You are liable if your user name or password is used by an unauthorised person. You agree to release and indemnify SSDEurope in connection with any use (whether authorised or unauthorised) of your user name or password. SSDEurope may suspend or cancel your account at any time without prior notice.

SSDEurope will comply with its Privacy Statement. SSDEurope will not reveal your personal information to external organisations except for the purposes of fulfilling your order or where you specifically authorise us to do so.

2. BUYING PRODUCTS FROM OUR WEBSITE

Ordering Goods

Any order placed by you in the manner described in this site is an offer by you to purchase a particular product or service for the price (including the delivery and other charges) specified on this site at the time you place your order. You acknowledge that, by placing your order, you are agreeing to pay for and accept delivery of the goods ordered unless you ask us to cancel that order, and we send you written confirmation of the cancellation prior to the goods being dispatched to you.

SSDEurope may change the prices published on this website at any time. While every effort has been made to ensure the accuracy of prices and information displayed on the website, we reserve the right to accept or reject your offer for any reason, including without limitation, the unavailability of any product, an error in the price or the product description posted on this site, or an error in your order. We may require additional verification or information before accepting any order. Please also note that prices may vary between our eBay shop and this website.

Purchasing and Payment

For each online order, you must pay:

  • the applicable price for the relevant goods confirmed by SSDEurope; and
  • the delivery fee specified on the website at that time.

Your order and credit card details are safe and secure. We use PayPal, a worldwide leader in fraud prevention technologies, for processing of all online payments. PayPal accepts debit and credit cards, and you can pay with or without establishing an account with PayPal.

Additionally, all personal information provided to SSDEurope is encoded using Secure Sockets Layer (SSL) technology, an encryption protocol that protects data as it travels over the internet. You can also pay by money order or cheque. Payment must be cleared before the goods are dispatched.

Delivery

The delivery fee is the fee as calculated by the website and showing on the order at the time of confirmation.

SSDEurope will engage a reputable courier or postal company (minimum registered mail) to deliver the goods you order to the address you specify in your order, within the agreed time frame, subject to their availability. Where it makes practical sense, we will at our option engage our distributor or the manufaturer as our agent to engage a courier or postal company to send the goods you have ordered directly to you. You agree to accept the terms and conditions of the carrier used.

Unless specified in the main page for the product category, delivery usually occurs within 5 business days to Irish addresses, and within 10 business days to non-Irish addresses, exluding customs and local delivery times.

All purchases are under Incoterms: EXW (Exworks)

It is your obligation to make insurance arrangement for goods lost and or damaged in transit. Otherwise goods are not covered once they leave our business premesis or the business prmesis of our agent.

Where the goods are not availabile we will notify you of this as soon as possible. Anyone at the delivery address who receives the goods will be presumed to be authorised to receive the goods. If there is no one at the delivery address, SSDEurope or its agent may charge you reasonable additional delivery fees.

Title and Risk

Title to the goods purchased on this site does not pass from SSDEurope to you until we have received payment in full for the goods. All risk in the goods passes to you once delivery commences.

Returns Policy

If you are not 100% satisfied with your purchase as it does not suit your needs you may return the item in its original condition within 14 days and we will offer you a complete refund of the purchase price and less postage charges.

If your item is dead on arrival, return it to us within 14 days and we will either send you a replacement item (if available), or refund your money.

Faulty goods need to be returned to SSDEurope with proof of purchase and an explanation of the fault. We will return these goods to the manufacturer for repair or replacement. If the goods are found to be faulty after testing the item will either be replaced or your money refunded. In case of human-caused defects such as:

a) Physical damage
b) Inappropriate usage and/or contact with damaging substances
c) When write limitation is exceeded due ineffective use (For example low grade MLC SSD used in 24/7 high performance servers)

While we will make every endeavour to ensure the information in this website is correct, true and forthright, this website is provided "as is" without any representations or warranties, express or implied. SSDEurope makes no representations or warranties in relation to this website or the information and materials provided on this website.

Without prejudice to the generality of the foregoing paragraph, we do not warrant that:

  • this website will be constantly available, or available at all; or
  • the information on this website is complete, tru, accurate or non-misleading.

Nothing on this website constitutes, or is meant to constitute, advice of any kind. If you require advice in relation to any technical or other matters you should consult an appropriate professional or technician.

Disclaimer of liability

To the extent permitted by law, SSDEurope will not be liable in contract, tort (including negligence) or otherwise, for any direct, indirect, special, consequential or punitive loss or damages or any loss or damages whatsoever, including (but not limited to) loss of use, data, or profits, arising out of or in connection with:

  • The use, copying, or display of the contents of this site.
  • Goods or services supplied by SSDEurope under these Conditions of Use.
  • A failure or ommission on the part of SSDEurope to comply with its obligations under these Conditions of Use

These limitations of liability apply even if we have been expressly advised of the potential loss.

Exceptions

Nothing in this website disclaiomer will exclue or limit any warranty implied by law that it would be unlawful to exclue or limit; and nothing in this website disclaimer will exclude or limit our liability in respect of any:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation on the part of us; or
  • matter which it would be illegal or unlawful for us to exclued or limit, or to attempt or purport to exclue or limit, its liability.

Reasonableness

By using this website, you agree that the exclusions and limitations of liability set out in this document are reasonable.

Unenforceable provisions

If any provision of these terms and conditions is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this website disclaimer.

Rights We Cannot Exclude

The above disclaimer and liability limitation do not exclude any rights, which by law may not be excluded, including but not limited to your rights under the Irish law.

Termination

Your ability to purchase goods from this site may be terminated by SSDEurope at any time without notice. All restrictions and licences granted by you and limitations of SSDEurope's liability survive termination.
